1. Acceptance of Terms

By downloading, installing, or using the Nutrispice mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Amlan Chatterjee ("we," "us," or "our") regarding your use of Nutrispice.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for your personal, non-commercial purposes

3.1 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, loan, sell, or distribute the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose

4. User Obligations

4.1 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

4.2 Accurate Information

• You agree to provide accurate, current, and complete information
• You will update your information to maintain its accuracy
• Providing false information may result in account termination

4.3 Age Requirement

You must be at least 13 years old to use this App. Users between 13-18 should use the App under parental guidance.

5. Health and Medical Disclaimer

5.1 Not Medical Advice

• The App provides nutritional information and meal suggestions based on general dietary guidelines
• The App is not intended to diagnose, treat, cure, or prevent any disease
• Always seek the advice of your physician or other qualified health provider with any questions about medical conditions
• Never disregard professional medical advice or delay seeking it because of something you read in the App

5.2 Individual Results May Vary

• Nutritional needs vary significantly between individuals
• Calorie estimates and nutritional information are approximations
• Consult with a healthcare professional before making significant dietary changes
• If you have food allergies, medical conditions, or take medications, consult your doctor before following meal suggestions

5.3 User Responsibility

You are solely responsible for:

• Verifying that suggested meals are appropriate for your health conditions
• Ensuring meals do not contain ingredients you are allergic to
• Consulting healthcare professionals about dietary changes
• Following food safety practices when preparing meals

5.4 Emergency Situations

If you think you have a medical emergency, call your doctor or emergency services immediately. Do not rely on the App for emergency medical assistance.

6. Intellectual Property Rights

6.1 Our Ownership

The App and all its contents, features, and functionality (including but not limited to software, text, images, graphics, logos, and designs) are owned by Amlan Chatterjee and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you submit to the App (such as photos, meal logs, or pantry items). By submitting content, you grant us a limited license to use, store, and process your content solely to provide the App's services to you.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you.

7. Privacy and Data Use

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, available at:

By using the App, you consent to our Privacy Policy and agree to the collection, use, and sharing of your information as described therein.

7.1 Health Data

• Apple Health integration is optional and requires your explicit permission
• You can revoke health data access at any time through iOS Settings
• Health data is encrypted and never shared with third parties

8. Prohibited Uses

You agree NOT to use the App to:

• Violate any local, state, national, or international law
• Infringe upon or violate our intellectual property rights or the rights of others
• Harass, abuse, or harm another person
• Submit false or misleading information
• Upload or transmit viruses or malicious code
• Spam or send unsolicited communications
• Interfere with or circumvent security features of the App
• Engage in automated data collection (scraping, bots, etc.)
• Attempt to impersonate another user or person
• Use the App for any commercial purpose without our written consent

9. Termination

9.1 Your Right to Terminate

You may stop using the App at any time and delete it from your devices. To fully terminate your account, you must request account deletion through the App's settings or by contacting us.

9.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

9.3 Effect of Termination

• Upon termination, your right to use the App immediately ceases
• We will delete your account data in accordance with our Privacy Policy
• Termination does not entitle you to a refund of any subscription fees
• Sections of these Terms that by their nature should survive termination will survive (including intellectual property rights, disclaimers, and limitations of liability)

10. Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information, content, or advice obtained through the App
• Warranties that defects will be corrected

We do not warrant that:

• The App will meet your requirements or expectations
• Any errors or bugs will be corrected
• The App or servers are free of viruses or harmful components
• Nutritional information is completely accurate for all meals

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMLAN CHATTERJEE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or similar issues transmitted to or through the App by third parties
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
• Any health-related decisions made based on App content
• Food allergies, adverse reactions, or health complications resulting from following meal suggestions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this document
• For material changes, we will notify you through the App or via email
• Your continued use of the App after changes take effect constitutes acceptance of the revised Terms
• If you do not agree to the modified Terms, you must stop using the App

13. Governing Law

13.1 Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

• Informal Negotiation: First, contact us to attempt to resolve the dispute informally
• Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in Santa Clara County, California
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions

13.3 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

13.4 Apple Terms

These Terms are between you and Amlan Chatterjee only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support services. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
